The 11th released two criminal opinions this week. The first was a pro se appeal of a denial of post-conviction relief. He missed the deadline, so it’s dismissed. State v. Hitchcock, 2014-Ohio-3281. Grendell, Cannon, Rice.
In State v. Cebula, 2014-Ohio-3276, he makes the deadline but it doesn’t help him any. Cebula pled guilty to Theft and two counts of Forgery for stealing money from his employer. He filed a Motion for Intervention in Lieu of Conviction, asking the court to impose mental health treatment. The trial court denied the motion, and the 11th says it was not an abuse of discretion to do so. Wright, Rice, Grendell.
